CONSENT TO TERMS AND CONDITIONS

Access to and use of the services of Anywhere But Here, LLC dba Anywhere But Here and our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using or obtaining any content, products, or services through our offices or through our website, you, the purchaser and/or traveler (“Customer” and “passenger” and “you/your”) agree to be bound by these terms. PLEASE READ THE TERMS BEFORE USING THIS WEBSITE. These terms and conditions govern the relationship between Anywhere But Here and you, the Customer. These terms restrict your rights and remedies and provide protection to Anywhere But Here. These also include warranty disclaimers and liability exclusions. By using this website you acknowledge and agree (a) this is a fair balance because this website is accessible by you conveniently and at no charge to access the website; and (b) if you do not agree or do not accept these Terms and Conditions, you can choose to not use this website or Anywhere But Here services. So, if anything is in these Terms and Conditions, including warranty disclaimers and liability exclusions, that you disagree with or are not willing to be bound by, or if something is missing from these Terms and Conditions that you consider essential, then you must not use this website or service. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, PLEASE DO NOT USE THIS WEBSITE OR ANYWHERE BUT HERE’S SERVICES. No alterations to these terms and conditions may be made by any ANYWHERE BUT HERE employee, authorized representative or agent, unless in writing by an authorized officer of ANYWHERE BUT HERE.

AGENT FOR SUPPLIERS

I understand that Anywhere But Here, LLC is not the source or supplier of the travel services I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold Anywhere But Here, LLC responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.

Anywhere But Here acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.

RISKS OF TRAVEL AND RELEASE

We assume no responsibility for and shall not be liable for the acts or omissions of any party not under our control, or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illnesses, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on “Find International travel Information” then click on “Country Information”, and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

I accept that Anywhere But Here, LLC is not responsible for, nor will I attempt to hold it liable for, any injury, damage, or loss I may suffer on account of any conditions, actions, or omissions that are beyond its reasonable control.

FOREIGN ENTRY RULES

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. You and your party is responsible to check these requirements, as we feel it is an invasion of privacy for any member of our staff to make such an inquiry.

TRAVEL DOCUMENTS

It is the responsibility of each Customer to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records. Anywhere But Here strongly recommends that you take into account that certain countries will not admit a passenger, if their passport expires within six (6) months of the date of entry. Non-United States citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing Customer to miss flight(s), and subsequent scheduled travel bookings on cruises and tours. Check each supplier’s website to ensure you and all members in your travel group or party obtain and carry travel documentation required.

Note to Client: Passport and visa information may be obtained by contacting the Travel Advisory Section of the U.S. State Department at 202.647.5225 or by visiting the State Department’s Web site at www.state.gov. NonU.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s Web site at www.cdc.gov.

When you receive any and all travel documents, it is the sole responsibility of the customer to review and verify all information. Contact Anywhere But Here immediately if changes or corrections are required. Should I find any errors on these documents, I must report them in writing to Anywhere But Here, LLC within 18 hours of receiving them.

I will review my travel documents for accuracy upon receipt and understand that I may contact Anywhere But Here, LLC if I have any questions. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money.

FEES AND PRICE DROPS

You agree to pay the travel planning, change, and other fees (if applicable) and will be presented to you prior to securing services. All of our fees are non-refundable. If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.

PRICE INCREASES

Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.

INSURANCE

For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. I understand that I may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.

CREDIT CARD MERCHANT

We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. However, if we are the credit card merchant, our role is to facilitate the sale, collect funds on your behalf, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse would be against the Suppliers, and you agree not to initiate a chargeback against us.

CLAIMS DEADLINE AND EXCLUSIVE JURISDICTION

You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in Denver County, Colorado will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.

TEXT (SMS) MESSAGE COMMUNICATION

As a part of the services provided while traveling, you are agreeing to allow Anywhere But Here to send you text messages, containing important information related to your trip. This will only be done 30 days before your travel starts, actively traveling, and no more than 7 days after your trip’s return date, and only for trips based within the USA. If you do not wish to be contacted in this manner, inform your travel advisor, and you will be removed from this type of communication.

GAYCATION.NET EVENT POLICIES

Gaycation Occupancy Rate Package Policies

  • You will receive a 100% refund if no rooms are available.
  • If your plans change, you can cancel your Gaycation Package based on the following guidelines:
    • Cancel on or before 90 days from the event start date – 100% refund
    • Cancel on or between 89 and 60 days from the event start date – 50% refund
    • Cancel on or after 59 days from the event start date – 0% refund
  • If you need to change your Gaycation Package to a lower room occupancy rate:
    • Change on or before 90 days from the event start date – 100% refund of the difference in current room occupancy package rates
    • Change on or between 89 and 60 days from the event start date – 50% refund of the difference in current room occupancy package rates
    • Change on or after 59 days from the event start date – 0% refund of the difference in current room occupancy package rates
      By purchasing a Gaycation Occupancy Rate package, you agree to pay the difference to increase your room occupancy to a higher level.

IF YOU FAIL TO INFORM ANYWHERE BUT HERE OF ROOM OCCUPANCY INCREASES, YOU WILL BE BILLED THE ADDITIONAL AMOUNT PLUS A $25 PENALTY TO COVER ANY ADDITIONAL PERSONS STAYING IN THE ROOM.
